If You're Detained or Deported

If the government detains or deports you, it may become impossible to care for your children. In that situation, they could be placed in foster care if there is no one else to take them. Making a plan now (and making it official) significantly increases the chances that the government will follow it.

MAKE A PLAN

Identify someone you trust who can take care of your children if you are taken: a family member, godparent, or close friend. Talk to them in advance and make sure they are prepared.

SIGN THESE TWO FORMS

Power of Attorney

This document gives your chosen caregiver legal authority over your children. If you are detained, show this form and request that the caregiver be contacted and given custody of your children.

Caregiver's Affidavit

This document allows your caregiver to act on your children's behalf with schools and hospitals while you are gone.

Both forms work together to protect your children and keep them out of foster care.
